  2. Throughout the website, the terms “we”, “us” and “our” refer to HealthEat Ltd.
  3. HealthEat Ltd is a company registered in Cyprus, HE442456, with registered office, Grigoriou Xenopoulou 10, Kyza Court, 3rd floor, office 301, 1061 Nicosia, Cyprus.

Acceptance of Terms and Conditions

  1. The Terms and Conditions govern any use of our website, healthy-meals.com.cy.
  2. This website is offered to the user upon acceptance of all terms, conditions, policies, and notices included within this document.
  3. The Terms and Conditions of Service apply to all site users, including without limitation users who are vendors, customers, merchants, contributors of content, and browsers.
  4. By visiting our site, and/or purchasing from us, you engage in the “Terms and Conditions of Service” and you agree with these Terms.
  5. In case you do not agree with these Terms or use any of the services provided, you may not access the website or consent to any of the services provided.
  6. Any features included or may be added in the future shall all be subject to the Terms and Conditions of Service.
  7. Occasionally we may review the Term and Conditions of Service, where a revised version will be updated on our website. It is the responsibility of the user to read the current version.
  8. A breach or violation of any of the Terms and Conditions of Service will immediately terminate your services.
  9. We reserve the right to refuse service to anyone for any reason at any time.

Credit Card Information – Payment Gateway

  1. The payment gateway is provided by VPayments, a partner of Worldline.
  2. We do not keep any credit card information for any reason.

  2. You must not use the website or information included on the website for any purpose that is unlawful or prohibited by the Terms and Conditions of Service.
  3. You must not transmit any virus of any nature.
  4. Your content (not including Credit Card information) may be transferred unencrypted.
  5. The website may include links to third-party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites. You acknowledge and agree that we are not responsible for the content or availability of such sites.

Modification of the services and prices

  1. Without prior notice, our product prices can change.
  2. We reserve the right to change or stop providing the Service (or any feature or content herein) at any time and without prior notice.
  3. Any time the Service is altered, its price is changed, it is suspended, or it is discontinued, we won’t be responsible to you or any third parties.
  4. We reserve the right, but are under no obligation, to restrict the distribution of our products or services to any individual or geographic area.

  6. We reserve the right to set a limit on the number and quantities of any goods or services we provide.

  3. Unless as required by law, we do not commit to update, revise or clarify anything in the services connected website, including price information
  4. There should be no defined update or refresh date applied in the service or on any connected website.

User feedback – comments/complaints

  1. You agree that your comments will not be infringed on by any party including copyright, trademark, privacy, personality, or any other personal or property right.
  2. You also agree that your comments will not contain libelous or otherwise unlawful content, nor will they be abusive or obscene.
  3. We may, but have no obligation to, monitor, edit, or delete information that we believe in our sole judgment is offensive, threatening, or libelous.

In no event shall Health Eat Ltd, our Directors, officers, employees, affiliates, agents, contractors, suppliers, and service providers, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages including without limitation, lost profits, lost revenue, lost savings, loss data, replacement cost, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise.

Indemnification

You consent to defend, hold harmless, and indemnify Health Eat and its parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys’ costs, made by any third party due to or arising out of your violation of these Terms of Service or the documents they incorporate by reference or your violation of any law or the rights of a third party.

Severality

  1. The unenforceable portion of any provision of these Terms of Service shall be deemed to be severed from these Terms of Service, and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by applicable law. If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination – Cancellation

  1. For all reasons, the parties’ responsibilities and liabilities accrued before the termination date will survive the termination of this agreement.
  2. These Terms of Service are in effect until either you or we terminate them.
  3. You may terminate these Terms of Service at any time by notifying us that you no longer wish to utilize our Services or by discontinuing the use of our website.
  4. If, in our sole discretion, you fail to comply with any term or provision of these Terms of Service, or we suspect that you have failed to comply, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination; and/or we may deny you access.
  5. If for any reason you wish to cancel your order, the following cases may apply:
    a. Cancel prior to the beginning of the week, i.e. Sunday or before. In this case, a full refund will be credited to your account in Healthy Meals for future use.
    b. Cancel after the week has started. As this affects the planning of the kitchen, please contact info@healthy-meals.com.cy

Refund

  1. As a general principle any amounts to be returned to the customer, i.e. for Termination – Cancellation is credited to the customer’s account for future use.
  2. For special cases, please contact us at info@healthy-meals.com.cy or by phone.

Delivery

  1. During delivery, we try to keep separate hot from cold in order the one not to affect the other.
  2. In cases when the temperature is very high, and the delivery may take longer than normal, we keep the meals in a thermos located in the delivery vehicles.
  3. Delivery times are noted during the checkout process.
  4. At delivery in case there is no person to collect the food, as a policy we do not leave the meals unattended, i.e., hung the bag on the door. The meals will be taken to an Etherio supermarket from where can be collected. Please contact us via phone for better information.

Governing Law

  1. These Terms and Conditions and any separate agreements whereby we provide services, (whether contractual or non-contractual) shall be governed by and construed in accordance with the laws of the Cyprus Republic and you agree to the jurisdiction of the courts about any such dispute or claim.
